Contract Question time: If someone, driving your car, parks on private property that is controlled by a private parking enforcement agency are you liable for the fine? They send their 'charge notice' via the post to the registered owner which is you. The car park is adequately signed.
Private parking enforcement agencies are becoming more common. They do not benefit from parking regulations set out in the Road Traffic Act 1984 and so rely on notices to create a contract with the driver: But, what if your car was being driven by someone else? Would the courts be influenced by s107 Road Traffic Act 1984?
